In 2021, the Canadian Securities Administrators (CSA) published guidance for crypto issuers that own or hold crypto assets. This article examines five cases that may define the future of digital asset regulation in the United States and sets out the issues at stake in those cases. These cases are the Second Circuit’s review of SEC v. Ripple Labs, Inc., the interlocutory appeal in SEC v. Coinbase, Inc., and three cases representing the industry’s shift toward offensive litigation against federal agencies — Blockchain Association v. IRS, Bitnomial Exchange, LLC v. SEC, and Kentucky et al. v. SEC. The purpose of this article is not to predict how those cases will progress — that determination is going to lie in the hands of the courts and policymakers — but rather to make clear what is at stake, especially in light of an anticipated shift in regulatory priorities regarding digital assets with the Trump administration, which could decide to no longer support the government’s positions in these cases.
In April 2023, Parliament approved measures that allow legislation requiring certain crypto service providers to seek an operating license. MiCA was provisionally agreed on in 2022 and placed into effect in July 2023. This legislation is intended to give regulators the tools they need to track crypto being used for money laundering and terrorism funding while providing users with protections.
This means that individuals and businesses must keep track of their cryptocurrency transactions and pay taxes on any gains they make from the sale or use of the cryptocurrency. This includes any profits made from mining cryptocurrencies.
In South Korea, cryptocurrencies are not considered legal tender and exchanges, while legal, are part of a closely-monitored regulatory system. Cryptocurrency taxation in South Korea is a gray area: since they are considered neither currency nor financial asset, cryptocurrency transactions are currently tax-free. However, the Ministry of Strategy and Finance has indicated that it is considering imposing a tax on income from crypto transactions and is planning to announce a taxation framework in 2022.
